Terms of Service
1. Acceptance and Eligibility
These Terms of Service (the "Terms") form a binding agreement between you and Work For You ("Work For You", "we", "our", or "us") governing your access to and use of the Work For You mobile application, website, and related services (collectively, the "Service"). By checking the acceptance box during sign-up, by tapping a button that signals agreement, or by otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms.
You must be at least 18 years of age and legally able to enter into a binding contract under the laws of the State of California to use the Service. For employment-related uses, you also represent that you are a U.S. resident or otherwise lawfully authorized to work in the United States.
2. Platform Status — Passive Matching Venue
Work For You operates solely as a passive, independent matching venue and directory connecting job seekers and employers. We are NOT an employment agency, staffing firm, recruiter, headhunter, or employer of record. We are NOT a party to any employment relationship, contract, offer, negotiation, or hiring transaction that may arise between users of the Service.
We do not endorse, sponsor, certify, verify, or pre-screen any job posting, employer, candidate, resume, message, or other content on the Service. All communications, offers, agreements, interviews, and engagements occur directly between users — we do not intervene unless we choose to enforce these Terms at our discretion.
3. Content Sources and Automated Aggregation
You acknowledge that job postings on the Service may originate from three distinct sources: (a) employers who directly post on the Service, (b) automated ingestion from publicly visible Telegram channels and other public web sources, and (c) manual administrative entry from public social-media content. Postings from sources (b) and (c) are extracted and classified by automated artificial intelligence (currently Google Gemini 2.5 Flash) and may contain inaccuracies, stale information, third-party links, contact details, or content that has not been independently verified by Work For You.
You agree that we make NO REPRESENTATION OR WARRANTY of any kind regarding the accuracy, currency, legality, authenticity, safety, or completeness of automatically aggregated content. You assume the entire risk of contacting or transacting with any party identified through such content.
4. Equal Opportunity and Anti-Discrimination
You agree that any content you post, share, transmit, or otherwise make available through the Service must comply with all applicable U.S. federal and California civil rights and equal employment opportunity laws, including without limitation:
• Title VII of the Civil Rights Act of 1964 • the Age Discrimination in Employment Act of 1967 (ADEA) • the Americans with Disabilities Act of 1990 (ADA) • the Pregnant Workers Fairness Act of 2022 (PWFA) • the Genetic Information Nondiscrimination Act of 2008 (GINA) • the Equal Pay Act of 1963 (EPA) • the California Fair Employment and Housing Act (FEHA) • the California Family Rights Act (CFRA)
You must not post, request, or imply preferences or limitations based on race, color, religion, sex (including pregnancy, sexual orientation, or gender identity), national origin, citizenship status (except where required by law), age (40 and over), disability, genetic information, marital status, veteran status, or any other characteristic protected by applicable federal, California, or local law. Hate speech, harassment, and unlawful discrimination are strictly prohibited and will result in immediate removal and account termination.
5. User Conduct and Prohibited Activities
You agree NOT to use the Service to engage in any of the following:
• Posting fraudulent, scam, pyramid, multi-level marketing, or “earn-from-home” schemes • Requesting any payment, fee, deposit, kit purchase, training fee, or other financial outlay from job seekers as a condition of applying or being considered for a role • Phishing, identity theft, harvesting personal data, or sending unsolicited commercial messages (spam) • Adult content, sex work, escort services, or sexually explicit material • Illegal activity, including human trafficking, controlled-substance cultivation or distribution in jurisdictions where prohibited, and any activity that would expose another user to criminal liability • Impersonation of any person, employer, or organization • Posting duplicate, misleading, or expired listings • Reverse-engineering, scraping, or attempting to access the Service by means other than the published mobile and web interfaces
We employ automated artificial-intelligence moderation systems that may block, remove, flag, or quarantine content suspected of violating these Terms. AI moderation decisions are made on a best-effort basis without human review and may produce false positives or false negatives. You have the right to appeal a moderation decision by contacting support.
6. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA AND FEDERAL LAW, WORK FOR YOU DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY, REGARDING:
(a) the accuracy, legality, completeness, or safety of job postings, whether user-submitted, employer-submitted, or automatically aggregated; (b) the truthfulness, completeness, or qualifications represented in any resume, profile, or candidate communication; (c) the conduct, identity, intentions, or solvency of any user, employer, or third party on or off the Service; (d) the outcome of any chat conversation, interview, offer, hiring decision, employment relationship, wages, working conditions, termination, or any consequence thereof; (e) uninterrupted, secure, or error-free operation of the Service, including notification delivery, AI processing, and third-party integrations (Stripe, Google Maps, Apple Push Notification Service, Google Firebase Cloud Messaging).
TO THE FULLEST EXTENT PERMITTED BY LAW, WORK FOR YOU’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (i) the amount you have paid to Work For You in the twelve (12) months preceding the claim, or (ii) one hundred U.S. dollars ($100). IN NO EVENT SHALL WORK FOR YOU BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOST EMPLOYMENT OPPORTUNITIES, OR LOST WAGES.
You agree to indemnify, defend, and hold harmless Work For You and its officers, employees, agents, and contractors from and against any third-party claim arising out of (i) your use of the Service, (ii) content you submit, or (iii) your violation of these Terms.
7. Data Handling, Privacy, and CCPA
Your use of the Service is also governed by our Privacy Policy, which forms an integral part of these Terms. The Privacy Policy describes how we collect, store, use, and share information, including resume content, chat messages, push notification tokens, geographic data, and analytics. California residents have additional rights under the California Consumer Privacy Act (“CCPA”), including the right to know, the right to delete, and the right to opt out of the sale or sharing of personal information. Please review the Privacy Policy for the full scope of those rights and how to exercise them.
You acknowledge and consent that contact information you elect to share inside the Service (for example, in a chat thread or on a job application) may be viewed and used by the other party to that conversation. We do not sell or trade your personal information.
8. Termination, Governing Law, and Severability
We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, for any reason, including suspected violation of these Terms. You may delete your account at any time from within the app or by contacting support.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles, plus applicable U.S. federal law. Any dispute, claim, or controversy arising from or relating to these Terms or your use of the Service shall be finally resolved by binding individual arbitration administered by JAMS in Los Angeles County, California, under its then-current rules. You and Work For You each waive any right to a jury trial and any right to participate in a class action, class arbitration, or representative proceeding against the other.
If any provision of these Terms is held invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be a waiver of such right or provision.
9. Changes to These Terms
We may revise these Terms from time to time. When we make a material change, we will bump the version number shown at the top of this document and prompt you to re-accept the updated Terms on your next use of the Service. Your continued use of the Service after the effective date of an updated version constitutes acceptance of that version.
Questions about these Terms may be sent to legal@work4you.app.
